Old Salt Festival 

Acknowledgement and Assumption of Risk Agreement

Please read carefully before electing to participate in Old Salt Festival.  This is a release of liability and waiver of certain legal rights.

1. I agree and understand that the decision to attend and participate in the Old Salt Festival (“Old Salt Festival”) is made on a purely voluntary basis, with knowledge of the existence of risks and of the terms of this agreement.  I agree and understand that participation in the Old Salt Festival subjects me to risk of injury regardless of all feasible safety measures.  I assume all risks associated with attending and participating in the Old Salt Festival, including but not limited to risks inherent in outdoor activities and in activities with large crowds in an undeveloped area, including dangerous conditions caused by the movement of crowds, of event participants, slipping and falling, drowning, dehydration, hypothermia, sunburn, injuries caused by insect or wildlife encounters or attacks, blisters, and injuries due to natural phenomena such as wind, sudden weather changes, fire from open flames and campfires, lightning, and the like, as well as general personal injuries of a physical or psychological nature, pain, suffering, illness, temporary or permanent disability.  These risks may cause serious personal injury or even death.  I hereby expressly assume and accept any and all risk of injury or death arising out of my attendance and participation in the Old Salt Festival.

2. I hereby release Old Salt Co-Op, LLC, Mannix Brothers, Inc., Mannix-Raymond Ranch, LLC, Mannix Brothers Ranch, LLC, all of their officers, directors, agents, servants, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, investors, sponsors, partners, participants, vendors, artists, firms or corporations liable or who might be claimed to be liable, whether or not herein named or listed, of and from any liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage or injury, including death, to both person and property, that may be sustained by me related in any way to the Old Salt Festival.  I agree that this Agreement may be relied upon by Old Salt Co-Op, LLC, and any of the parties described above, to establish a complete defense in the event of any action arising out of my attendance and participation in the Old Salt Festival in any way, and I agree and understand that neither Old Salt Co-Op, LLC, nor any of the parties described above, has any duty to keep me free from injury, damage, loss, death, or any other consequence of my decision to attend and participate in the Old Salt Festival.  I further agree to pay for any damages caused to others, including attorney’s fees and costs, if they are injured or otherwise damaged due to any negligent actions on my part.  This release shall be binding on my heirs, executors, personal representatives, successors, and assigns.

BY ELECTING TO PARTICIPATE IN THE OLD SALT FESTIVAL, I HEREBY AFFIRM THAT I HAVE CAREFULLY READ THE FOREGOING ACKNOWLEDGEMENT AND ASSUMPTION OF RISK AGREEMENT AND UNDERSTAND ITS CONTENTS.

IF I AM UNDER 18 YEARS OLD, MY PARENT OR GUARDIAN AFFIRMS THAT THEY HAVE CAREFULLY READ THE FOREGOING ACKNOWLEDGEMENT AND ASSUMPTION OF RISK AGREEMENT AND THAT THEY UNDERSTAND ITS CONTENTS.
